1. Acceptance of Terms

By accessing or using flasHR ("the Platform"), operated by flasHR ("we", "us", "our"), you agree to be bound by these Terms & Conditions and our Privacy Policy below. If you do not agree with any part of these terms, you must not use the Platform. These terms apply to all users of the Platform, including organizations (schools, educational institutions) and their authorized personnel.

2. Description of Service

flasHR is an AI-powered hiring platform designed for educational institutions to streamline teacher recruitment. The Platform provides:

Resume upload, parsing, and AI-assisted scoring and analysis
Native in-app application form builder with shareable links
Video response collection, transcription, and AI evaluation
Automated candidate outreach via email and AI-powered voice calls
Background verification (BGV) form distribution and tracking
Email inbox monitoring for incoming applications
Candidate pipeline management and stage tracking
Organization and team management with role-based access

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

Each account is intended for use by a single individual.
Sessions are restricted to one device at a time. Signing in on a new device will terminate any existing session.
Email verification is required before you can access the Platform.
You may sign in using email/password or Google OAuth.
We enforce rate limits on authentication endpoints to protect against abuse.

4. Organizations and Data Ownership

Organizations (schools and educational institutions) retain ownership of all candidate data, project data, and organizational content they upload or create on the Platform. As an organization administrator, you are responsible for ensuring you have obtained appropriate consent from candidates before uploading their personal information, resumes, and other data to the Platform.

5. AI-Powered Features

The Platform uses artificial intelligence provided by third-party AI services (including Anthropic Claude, OpenAI, and Google Gemini) for:

Resume analysis and scoring based on job criteria
Written application response evaluation
Video response transcription and analysis
Email attachment classification
AI-powered voice calls for candidate outreach

AI-generated assessments, scores, and recommendations are provided as decision-support tools only. They should not be the sole basis for hiring decisions. Human review of all AI-generated outputs is strongly encouraged. We do not guarantee the accuracy, completeness, or fairness of AI-generated results.

6. Voice Calls and Recordings

The Platform may place automated voice calls to candidates on your behalf using our AI-powered calling service. These calls may be recorded and transcribed. You are responsible for ensuring compliance with all applicable laws regarding automated calls and call recording in the jurisdictions where your candidates are located, including obtaining any required consent.

7. Gmail Integration

When you connect your Google account, the Platform requests read-only access to your Gmail inbox to monitor incoming candidate applications. You can revoke this access at any time through your Google Account settings. We store an encrypted token to maintain this connection and access only the data necessary to provide the requested features.

8. File Uploads

You may upload resume files (PDF format, up to 10 MB each) to the Platform. Uploaded files are stored securely on cloud infrastructure. You are responsible for ensuring you have the right to upload any files and that they do not contain malicious content. We reserve the right to scan uploaded files for security purposes.

9. Acceptable Use

You agree not to:

Attempt to gain unauthorized access to the Platform or its systems
Interfere with or disrupt the Platform's operation
Upload malicious, fraudulent, or unlawful content
Use the Platform for any purpose that violates applicable laws, including employment discrimination laws
Reverse-engineer, decompile, or attempt to extract the source code of the Platform
Use automated scripts or bots to access the Platform without our prior written consent
Upload candidate data without appropriate consent or legal basis

10. Intellectual Property

The Platform, including its design, code, AI models (as configured), and documentation, is the intellectual property of flasHR. Your use of the Platform does not grant you any ownership rights in the Platform itself. You retain all rights to the data you upload.

11. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. You may request export or deletion of your data by contacting us at developer.hragent@gmail.com.

12. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability for any claim related to the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless flasHR and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights, including the rights of candidates whose data you process through the Platform.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

15. Modifications

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or through the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

This policy applies to all users of the Platform, including organization administrators, team members, and candidates whose data is processed through the Platform.

2. Information We Collect

2.1 Account Information

When you create an account, we collect:

Full name and email address
Password (stored in hashed form)
Profile image (if provided)
Google account information (if you sign in with Google)

2.2 Organization Information

When you create or join an organization, we collect:

Organization name and logo
Member roles and permissions
Invitation details (email addresses of invitees)

2.3 Candidate Data

When organizations upload or collect candidate information, the following data may be processed:

Personal details: name, email, phone number, current school, city
Professional details: years of experience, subject specializations
Resume files and extracted text content
Application form responses (via the in-app form builder)
Video responses and their transcriptions
AI-generated analysis scores and evaluation results
Call recordings and transcripts from automated voice calls
Background verification form submissions
Email correspondence related to the hiring process
Pipeline stage and hiring status

2.4 Automatically Collected Information

When you use the Platform, we automatically collect:

IP address
Browser type and user agent
Session information and device identifiers
Error reports and performance data (via Sentry)

3. How We Use Your Information

We use collected information to:

Provide and operate the Platform, including all hiring pipeline features
Process and analyze resumes, applications, and video responses using AI
Send emails to candidates on behalf of your organization (outreach, interview invitations, follow-ups, BGV requests)
Place automated voice calls to candidates on behalf of your organization
Monitor your connected Gmail inbox for incoming candidate applications
Authenticate your identity and manage your sessions
Send you account-related communications (verification emails, password resets)
Diagnose technical issues and improve Platform performance

4. AI Processing

Candidate data (including resume text, form responses, and video transcriptions) is sent to third-party AI providers for analysis. We use the following AI services:

Anthropic (Claude) — for resume analysis, form response evaluation, and content classification
OpenAI — for resume analysis and form response evaluation
Google (Gemini) — for resume analysis and form response evaluation

Data sent to AI providers is processed according to their respective data processing terms. We do not use candidate data to train or fine-tune AI models. AI providers may process data on servers located outside your country of residence.

5. Third-Party Services

We use the following third-party services to operate the Platform. Each service processes data according to its own privacy policy:

Resend — email delivery service for sending verification emails, candidate outreach, interview invitations, and other communications
Ringg.ai — AI-powered voice calling service for candidate outreach and interview invitations, including call recording and transcription
Deepgram — speech-to-text transcription of candidate video responses
Google Gmail API — read-only inbox monitoring for incoming candidate applications
Vercel — hosting, serverless functions, and cloud file storage (Vercel Blob) for resumes and video files
Sentry — error tracking and performance monitoring (may collect IP addresses, browser information, and stack traces that include local variable values)
Neon / PostgreSQL — database hosting for all Platform data
Inngest — background job orchestration for processing pipelines

6. Cookies and Local Storage

The Platform uses:

Session cookies — essential for authentication and keeping you signed in
Preference cookies — to remember UI preferences such as sidebar state
Session storage — for temporary UI state that is cleared when you close your browser

We do not use advertising or third-party tracking cookies.

7. Data Security

We implement appropriate technical and organizational measures to protect your data, including:

Passwords are stored using secure one-way hashing
Google OAuth tokens are encrypted at rest
Sessions are enforced to a single device at a time
Rate limiting on authentication endpoints to prevent brute force attacks
Webhook signature verification for incoming data from third-party services
All data transmitted over HTTPS/TLS encryption

While we strive to protect your data, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.

8. Data Retention

We retain your data for as long as your account is active or as needed to provide the Platform services. Specifically:

Account data is retained until you request deletion of your account
Candidate data (resumes, scores, analyses) is retained for the duration of the organization's account unless deletion is requested
Call recordings and transcripts are retained for as long as the associated project is active
Video files and transcriptions are retained for as long as the associated project is active
AI evaluation logs (including token usage and cost data) are retained for operational and billing purposes

Upon account deletion, we will delete or anonymize your data within 30 days, except where retention is required by law.

9. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

Access — request a copy of the personal data we hold about you
Correction — request correction of inaccurate or incomplete data
Deletion — request deletion of your personal data
Portability — request an export of your data in a structured, commonly used format
Objection — object to processing of your data for certain purposes
Restriction — request restriction of processing in certain circumstances

Candidates whose data has been uploaded by an organization should contact that organization directly to exercise their rights. Organizations may contact us at developer.hragent@gmail.com to facilitate data subject requests.

10. International Data Transfers

Your data may be processed and stored on servers located outside your country of residence, including in the United States and other countries where our third-party service providers operate. By using the Platform, you consent to the transfer of your data to these locations. We ensure that appropriate safeguards are in place for such transfers in accordance with applicable data protection laws.

11. Children's Privacy

The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from children. If you believe we have collected data from a minor, please contact us immediately at developer.hragent@gmail.com.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes via email or through the Platform. The "Last updated" date at the top of this policy indicates when it was last revised. We encourage you to review this page periodically.
